1. Validity of Conditions

The following general terms of business (AGB) are valid for all contracts, which are made with Hotel Ludwig, as far as they include all parts of the AGB-law. They can be replaced by especially negotiated conditions. All AGB-conditions are displayed in various places in the hotel and are handed to the guest or customer if special conditions have been negotiated.

2. Conclusions of Guest-Accommodation-Contracts

Relevant is the actual price list including conditions and descriptions of works. Extra services can be negotiated. The guest-accommodations-contract (Beherbungsvertrag) can be done in writing, orally, by telephone or through conclusive behavior. Both partners are obligated to fulfill the contract independent on the length of the time period.
In case of a night’s stay the contract is accepted as soon as the room is ordered and acknowledged or – in case there isn’t enough time to send an ok – is available.

3. Reservation

When rooms or other services (e.g. meals) have been reserved on an optional basis, both partners are bound by it. After the time period agreed upon Hotel Ludwig may decide anew about the options. Reserved and by the hotel confirmed rooms are available from 14:00 hrs on the day of arrival until 12:00 hrs. on departure day. Hotel Ludwig is entitled to sell reserved rooms after 18:00 hrs on arrival day, as long as no later arrival time has been agreed upon.

4. Change of Price

Agreed upon prices may be changed according to new price lists if more than 4 month have passed since the contract.

5. Conditions of Payment

Ills are payable immediately and without discount and in cash if no other conditions are agreed upon.
Hotel Ludwig may accept a credit card when presented even if signs in the hotel tell about acceptance of all credit cards.
Acceptance of checks, credit cards or any other means of payment is done only as fulfillment.
Delay of payment of just one bill entitles Hotel Ludwig to send a reminder indicating a certain time limit and point out the sequences.
If the bill is for more than €250.00 and if a guest stays more than 6 days hotel Ludwig may present in-between-bills and ask for payment.

6. Payment in Advance

Hotel Ludwig is entitled to ask for advance payment for hotel accommodation from a guest who has not reserved when signing the contract.
Hotel Ludwig can ask for payment in advance of all intended costs in part or in full, if there haven’t been any reservations.

7. Cancellation / Cost of Cancellation

If a guest cancels or does not use any services offered by the hotel or reserved services are not used by the guest (especially hotel accommodation, rent of conference rooms or meals) the hotel is allowed to bill the guest for the following flat rates:
Cancellation between the 30th and 15th day before use of the service: 30% of the cost for the reserved/ordered service.
Cancellation between the 14th and the 8th day before use of the service: 60% of the cost for the reserved/ordered service.
Cancellation between the 7th and 3rd day before use of the service: 80% of the cost for the reserved/ordered service.
Cancellation within 48 hrs before use of the service or no use of the service: 100% of the cost for the reserved/ordered service.
Cancellation costs will be reduced if Hotel Ludwig is able to sell the reserved room or service.
There will be cancellation costs even if the guest cancels some of the services or uses the reserved/ordered services without having them cancelled.

8. Liability

Hotel Ludwig is liable according to §§ 701 – 703 Bürgerliches Gesetzbuch (BGH). There is no liability for any other reasons, if the damage isn’t caused intentionally or carelessly by Hotel Ludwig or its representatives.

9. Withdrawal of the Hotel

a) The hotel cannot withdraw from a contract. The only exceptions “are force majeure” or strike.
b) In case of failure to provide the reserved room the hotel must offer of an equivalent room or one in the same price category.

10. Additional Conditions

a) The law of the Federal republic of Germany is valid for all relations between the guest and Hotel Ludwig.
b) The courts at the place of Hotel Ludwig is domicile for all legal cases involved.
